  • 2013-SEP-06: NM: SSM Chaos to be resolved: Same-sex couples can currently obtain marriage licenses In 7 of New Mexico's 33 counties. Some country clerks have personally determined that the state constitution requires marriage equality. Others have been ordered to issue marriage licenses by their county's District Court. Over 1,000 marriage licenses have been provided, but it is not clear whether subsequent marriages will be honored by the courts long-term.

    In response to the request of all 33 county clerks and the "New Mexico Association of Counties," the state Supreme Court agreed on SEP-06 to end the current chaotic situation in New Mexico. 1 The court will rule whether same-sex marriages are legal in the state. Hearings will be held on OCT-23. More details.

  • 2013-SEP-09: HI: Governor calls Legislature into a special session: Governor Abercrombie (D) released the draft of a bill that would legalize same-sex marriage in Hawaii. In the past, he indicated that he would call the Legislature into a special summer session only if it appeared that there was sufficient support to pass the bill into law. On SEP-09, he seems to have concluded that the Legislature would pass a marriage equality bill, and so he initiated the special session. It is expected to start on OCT-28 and last for about 5 days. Passage of the bill by the Senate looks very likely. Votes in the House are closer. More details.

  • 2013-SEP-27: NJ: Court orders New Jersey to legalize SSMs: Shortly after the JUN-26 decision by the U.S. Supreme Court that gutted the federal Defense of Marriage Act, the plaintiffs in the New Jersey lawsuit "Garden State Equality v. Dow" applied to the Superior Court of New Jersey for a summary judgment. According to Kate Zernike and Marc Santora of the New York Times, Judge Jacobson of Superior Court:

    "... ruled on Friday that the state must allow same-sex couples to marry, saying that not doing so deprives them of rights that were guaranteed by the United States Supreme Court in June.

    It is the first time a court has struck down a state’s refusal to legalize same-sex marriage as a direct result of the Supreme Court [DOMA] ruling, ... With lawsuits pending in other states, it could presage other successful challenges across the country."

    Judge Jacobson ruled, in part:

    "The ineligibility of same-sex couples for [1,138] federal benefits is currently harming same-sex couples in New Jersey in a wide range of contexts. Same-sex couples must be allowed to marry in order to obtain equal protection of the law under the New Jersey Constitution."

    Governor Chris Christie's [R] office has indicated that the ruling will be appealed directly to the New Jersey Supreme Court.

  • 2013-SEP-30 to OCT-05: NJ: Fairleigh Dickinson University poll shows registered voters favor same-sex marriage almost two to one. Also, 75% of Democratic registered voters favor SSM. By a plurality of 2 percentage points, even Republicans favor SSM. 2

    Governor Chris Christie (R) has achieved a record that to our knowledge is unique in the history of the United States: He has vetoed a bill that:

    • A majority of legislators in the State Senate approved.
    • A majority of legislators in the State House approved.
    • A majority of Democratic voters approved.
    • A majority of Independent voters approved.
    • A majority of Republican voters approved. *
    • A majority of voters of all parties approved.

    * There was only a 2 percentage point majority among Republicans which is within the margin of error. It is not statistically significant.
